First, when it comes to who owns something legally, only the contract knows. If there’s no contract that specifically states the ownership of the sample/recording, then you go to who’s actually ON the recording. However, my guess, is that Felix and Diddy will back one another up, regardless which of them actually owns the vocal.

Second, the only way that this is all ok, is if DJ Hell has ok’d the use of the sample. And, we know he hasn’t. So, he’ll be fined. How much will be determined by Diddy’s and Felix’s management, whomever of them actually owns the sample.

Lastly, for other examples of this type of thing, go look up The Verve and Bittersweet Symphony… They ended up getting screwed out of a LOT of profit from that single, because they never cleared the sample.

The worse part of this, is the crappy song that Diddy’s vocals are on. I’m with DJ So What. That track is pretty boring. Heh.

“Legally, songs may only be copied or performed publicly by permission of the authors. ” (Wikipedia).

The author of the work in question is P Diddy. NOT Felix.

If allegations are correct than Hell took the sample from Felix..which means the only time Diddy was involved..was when DIDDY recorded the vocals with felix in 2003. And according to many sources Hell didn’t receive clearance from Diddy or Felix. But you’re right lets see what Hell has to say in defense and lets see what Diddy says.

We should wait until P Diddy (the owner of the copyright material in this altercation) says something.

When you pen and sing a lyric, you own that material. Felix doesn’t. He may have had some mechanical involvement with the recording, depending on what P Diddy and him agreed to at the time (probably it was that P Diddy could use it at will to be honest, knowing these things).

Does anyone here truly believe that one of the most successful label owners, a massive DJ, and recording artist, wouldn’t get clearance from P Diddy for this work? It even mentions P Diddy in the track title, which would certainly get the relevant royalty body interested.

Hell wasn’t ’sampling’ the vocal, he was using it as the vocal track. It’s not somehow ‘masked’ that he used the vocal, it’s the whole point of the track.

I think everyone should take a count to ten here, and not ride the wagon of hate until we see what Diddy and Hell have to say…

Remember, this is the music industry, it’s a messy world.

who mr. housecat owns the rights on the vocals?
Thats the point for me. Hell mentioned he took it from an old recording. He also names diddy in all his credits. would be funny if he had no permission cuz this track is available in the net for over a year !!
And now when he finally puts out the single with the great remixes you call him a thief, guess you just want to make some of the profit of this release. Its very strange you all just now recognize this track….

anyway at the end the contracts will decide. I just loved this great track, its remixes and also the nonvocal parts ….

Agreed and to reiterate I think that is definitely the point some people aren’t getting. Yes, I understand that all kinds of songs are made from samples of other songs..Daft Punks Robot Rock is a great example…but if you listen to the original audio and you listen to Hell’s version its more than just a sample…He pretty much USED all of it..except any of the parts where DIDDY mentions Felix’s name…cuz YES this audio recording was DIDDY talking to FELIX.

I’ve already said my piece about this but what pisses me off is some of the comments here that are downplaying the situation like its no big deal. You don’t steal vocals from someone elses feature production and make a new production with the vocals and say its yours, sell it and give no credit/acknowledgement to the source (and I’m talking about felix not diddy because felix made it happen). This is serious it does not matter how good or bad dj hell’s album is etc he’s a thief at the end of the day and should be dealt with accordingly. Yes people steal samples from each other all the time but its one thing to sample and another to steal a whole 3 min vocal and act like its yours and take someones name out. Electronic music is a booming culture and is getting pushed to the forefront of music as we have an influence on almost of every genre of music today. So when you have an innovator and pioneer like felix being ripped off to downplay it is an insult to the artist and the culture itself. Dj hell will be dealt with one way or another.

Perhaps you should be directing your rant at Diddy rather than Hell? “The DJ” is the worst track on Teufelswerk by a LONG way (even the remixes are terrible!) & I don’t see why Hell would’ve included it without Diddy’s implicit say-so? And is Felix seriously suggesting that he’s NEVER “stolen” another artist’s work? My only concern is why a producer as great as Hell would want to be associated with a conceited jerk like Diddy in the first place…

I don’t exactly know what to think of it. What does Diddy say? Did he know about it? On the other hand it’s not the first time that I heard someone accusing Hell of stealing someones unreleased tracks, so I really don’t know what to think of it yet.
